State vs. C.R.E. (Bexar County)

  • OFFENSE: ASSAULT BODILY INJURY

  • FACTS: Client, a Guiness World Record holding Stunt Motorcyclist, was arrested and charged with beating a man at a Monster Truck Show in the pit area of the Alamo Dome. The State had five witnesses (5) testify that Client had jumped out of his truck and for no reason, started assaulting complainant, breaking his nose. Mr. Hernández's clear grasp of the legal issues won every contested issue presented in the case against his Client. Mr. Hernández's tenacious cross examination and passionate arguments won the day with the jurors who deliberated very quickly with a 20 minute Not Guilty Verdict.

  • FACING: 1 YEAR JAIL AND A $4,000.00 FINE (ALSO A CIVIL LAW SUIT FILED BY COMPLAINANT THAT LOST TRACTION AS A RESULT OF THE CRIMINAL CASES NOT GUILTY VERDICT)

USA vs. A.H. (Western District of Texas)

  • OFFENSE: POSSESSION WITH INTENT TO DELIVER OVER A 1,000 grams of COCAINE
  • FACTS: Client investigated and arrested by law enforcement agents for possession of a brick of Cocaine wieghing one kilogram along with another 500 grams wrapped in foil, with a Mexican Cartel stamp on the packaging. Mr. Hernández's investigation revealed that officers did not act lawfully during their investigation and subsequent search and siezure of his client.
  • FACING: 20 YEARS TO LIFE IN A FEDERAL PRISON
  • RESULT: DISMISSAL OF ALL CHARGES

    State vs. M.S.C. (Bexar County)

    • OFFENSE: ASSAULT BODILY INJURY-FAMILY
    • FACTS: Client allegedly slammed ex-girlfriends head against the wall outside of her apartment while holding thier 2 year old son. At trial, SAPD officer was discredited for his poor investigation of the allegation and ex-girlfreind was absolutely discredited as well.
    • FACING: One year in jail, $4,000.00 fine plus a host of rights stripped away as a result of a Finding of Family Violence. ie: 2nd Amend Right to bear arms etc...
    • RESULT: NOT GUILTY/ TRIAL ACQUITAL

    State vs. D.G. (Bexar County)

    • OFFENSE: DWI

    • FACTS: Client returning home from a KISS concert is pulled over by SAPD officer for speeding and weaving on I-10. Client fails all Field sobriety tests and is arrested for DWI. At trial, Officer was discredited by Mr. Hernández's thorough cross examination of the officers knowledge and procedures employed in the officers investigation for DWI.

    • FACING: 6 months jail, $2,000.00 fine and Drivers License Suspension.

    • RESULT: NOT GUILTY/ TRIAL ACQUITAL

    State vs. R.W. (Comal County)

    • OFFENSE: AGGRAVATED ASSAULT WITH A DEADLY WEAPON(FIREARM)
    • FACTS: Client, in a drunken stupor at his home, allegedly opened fire and emptied out all 15 rounds of his 40 caliber Glock at his ex-wife and daughter. After a one and a half hour stand-off with Comal County Swat officers, client surrendered. At trial, ex-wife and several uniformed police officers and detectives were discredited by Mr. Hernández's relentless cross examination.
    • FACING: A two count 2nd Degree Felony Indictment, 20 years per count.
    • RESULT: NOT GUILTY/ TRIAL ACQUITAL ON BOTH 2nd DEGREE CHARGES

    State vs. M. M. (Bexar County)

    • OFFENSE: DWI
    • FACTS: U.S. Army Colonel dangerously weaving in traffic, failed all field sobriety tests given by SAPD DWI Task Force officer.
    • FACING: 6 months jail, $2,000.00 fine, Drivers License Suspension, Military Disciplinary Action.
    • RESULT: DISMISSAL OF ALL CHARGES

    State vs. J. R.G. (Bexar County)

    • OFFENSE: POSSESSION OF MARIJUANA
    • FACTS: Client stopped for a traffic violation, SAPD officer observes a baggie of marijuana in plain sight.
    • FACING: 6 months in jail and a $2,000.00 fine.
    • RESULT: DISMISSAL OF ALL CHARGES.

    State vs. F.M. (Bexar County)

    • OFFENSE: ASSAULT BODILY INJURY-MARRIED
    • FACTS: Client accused of striking his wife with his hands causing multiple contusions on her neck and body.
    • FACING: 1 year in jail and a $4,000.00 fine and a finding of family violence.
    • RESULT: DISMISSAL OF ALL CHARGES.

    State vs. E.P. (Bexar County)

    • OFFENSE: AGGRAVATED SEXUAL ASSAULT OF A CHILD
    • FACTS: Client accused in a seven (7) count Indictment alleging a host of sexual acts with an 11 year old girl. In the course of Mr. Hernandez's investigation, numerous inconsistencies were discovered which helped negotiate a fair plea for probation.
    • FACING: Life in Prison with Sexual Registration for Life.
    • RESULT: CHARGES REDUCED, Client pled No Contest to a one (1) count third degree felony with 10 years Deferred Adjudication and 10 year Registration.

    State vs. E.P. (Bexar County)

    • OFFENSE: FELON IN POSSESSION OF A FIREARM (Pre-Indictment)
    • FACTS: Client stopped for a minor traffic violation by aggressive SAPD unit is arrested for possessing an assault rifle.
    • FACING: 10 years in prison and a $10,000.00 fine.
    • RESULT: DISMISSAL OF ALL CHARGES.

    State vs. A.F.S. (Bexar County)

    • OFFENSE: AGGRAVATED ASSAULT ON A PUBLIC SERVANT
    • FACTS: On the first day of the calendar school year, Client was observed at St. Matthews Catholic School armed with a Glock semiautomatic handgun, a large Bowie knife, and wielding an aluminum bat. Officers responded and employed their Tazers to affect the arrest.
    • FACING: Life in Prison.
    • RESULT: NOT GUILTY BY REASON OF INSANITY

    State vs. H.L. (Bexar County)

    • OFFENSE: RESISTING ARREST/ PUBLIC INTOXICATION
    • FACTS: College student allegedly highly intoxicated on N. St. Mary’s Street, physically preventing officers from effecting her arrest.

    • OFFENSE: POSSESSION OF MARIJUANA
